Présentation

The LL.M. AWArDS combines the excellence of academics and practitioners in the field of international and investment arbitration (lawyers, counsels, arbitrators, quantum experts, managers of third-party funders, artificial intelligence researchers, etc.).

Courses are delivered in the heart of Paris (at the Institut de droit comparé and at prominent law firms).

The program covers both international arbitration and investment arbitration. It combines the French perspective with a comparative approach. It also deepens other core aspects of dispute resolution mechanisms: mediation, negotiation, settlement agreements, international business litigation, etc.

Objectifs

Core objectives:

  • To master the fundamental elements of both international arbitration and investment arbitration.
  • To comprehend the relationship between arbitral proceedings and state courts.
  • To broaden the understanding of international arbitration from a comparative perspective.
  • To acquire the indispensable knowledge from international arbitration and litigation practitioners (drafting clauses, briefs, pleadings, evidence, examinations and cross-examinations, establishing the quantum of damages, etc.)
  • To understand the functioning and distinctive features of the main arbitration centres and their rules.

The LL.M. program is offered in Paris, one of the most prominent international arbitration venues, internationally recognized as such.

The curriculum achieves the proper balance between an academic approach and a more empirical and practical approach to confront students, as prospective arbitration practitioners, with the complex realities of this multifaceted field of practice.

Expected number of students

The training targets to enroll between 20 and 30 students. The objective of this training is to welcome non-French-speaking foreign students to Paris-Panthéon-Assas University as part of a specialized training.

LLM AWArDS' candidates come from China, Brazil, Georgia, Germany, Greece, the Philippines, Turkey, as well as from three US partner law schools (Duke Univ., Georges Washington Univ., University of Virginia).

Access conditions

The selected students will be:

  • holders of an English-language training provided by a foreign university at a level equivalent to Master 2 (fifth year). For example, without exhaustiveness, in business law, contract law or civil business law, private international law or international trade law) and wishing to further develop their grasp of the law of international arbitration;
  • United States’ students who are enrolled in or have completed 2nd or 3rd year of legal training (JD);
  • practitioners (lawyers, in house counsels, etc.), with at least two years' experience, wishing to acquire new skills outside their current field of activity or wishing to further their training in their current field of business.

The selection will be made on the basis of an application file, if necessary, after an interview (including by videoconference).

The level of English of applicants, whose mother tongue is not English, will be assessed by the presentation of the TOEFL results:

- 100 for the internet version (iBT) of the test (with 25 for each section);

- 600 for the paper version (PBT) of the test (with 60 for each section and 5 for the Test of Written English).

If the applicant is unable to present the results of these tests, the level of English may be established differently, subject to an interview by videoconference with the head of the LL.M., if necessary.

About:

Entirely taught in English, the LL.M. in European Law is a university degree designed for international students. The courses are taught by a genuinely European team of highly qualified professors bringing together Paris-Panthéon-Assas University and reknown specialists from other European Member States.

The subject areas give students the opportunity to acquire a comprehensive understanding of European Law in most areas that fall within the competence of the European Union.

Language:

All classes are conducted in English. Students also have the opportunity to take French language classes if they wish to enhance their knowledge of French.

Academic Calendar:

From early September to early May.

Location of classes:

Classes will be held at the Comparative Law Institute, 28 rue saint Guillaume, 75007 Paris. French language courses are conducted at the Assas Centre, 92 rue d'Assas, 75006 Paris

Tuition fees and scholarships:

Students must pay a tuition fee of 10,000 Euros, payable in total by June 30th before the semester starts. In addition, students will pay administrative fees in the order of 260 Euros, and a national fee of 92 Euros.

No scholarship grant is available from Paris-Panthéon-Assas University.

The LL.M. in European Law is open to:

  • Students who hold a degree in social sciences with a major in law or any other law degree awarded by a non-French University after completing at least 4 academic years or 240 ECTS
  • Students who hold a Juris Doctor (J.D.)
  • Students who have successfully completed at least 2 academic years at an American Law School (through an exchange between their home University and Paris 2 Panthéon-Assas University).

Application & Admission:

The selection procedure is based on an assessment of the application submitted by each candidate, and, if the selection panel choose to do so, an interview (skype, phone) with the candidate to determine final selection.

The subject areas taught in the LL.M. in European Law give students the opportunity to acquire a comprehensive understanding of European Law in most areas that fall within the competence of the European Union.

Classes may be taught with a comparative and international perspective when appropriate to understand the Union’s legal system.

The Master in European Law consists of 11 seminars of 24h each, and 2 seminars of 12h each (288 hours of instruction in total):

Students may be permitted to replace an LL.M. seminar by another seminar taught in French within another program available at the European College of Paris. However, this may be done only with the agreement of the Director of Studies and the professor who teaches the seminar.

If a student wishes to write a thesis or a personal project on one of the specific seminars listed, they may replace one or several seminars for the project under the supervision of a Professor specific to the subject, with the consent of the Director of Studies. Each seminar is graded on the basis of 20 points. If the personal project replaces two seminars, the basis is 40 points.

The LL.M. is a university diploma (DU) and therefore not an equivalent to a Master's degree. 

The LL.M will offer the highest quality of teaching in small group seminars provided by leading French and international scholars. The program will benefit from a partnership with Institut Michel Villey, Paris-Panthéon-Assas University' leading research center in jurisprudence and constitutional law.

Career and prospects: 

  • International students aiming at acquiring a professional expertise in the field of democratic practice and democratic ingeneering. They will later work for NGOs, governmental bodies, international organizations. 
  • Students wishing to embrace an academic career and to read for a PhD.

Goals

The program’s purpose is to provide international students with a set of courses at the crossroads of public law, legal theory and theory of democracy. The aim is to enable a new generation of scholars and leaders in the field of law and democratic government, and provide them with the theoretical baggage and the skills to approach modern problems of democratic
governance and democratic reform. The emphasis will be put on legal theory and political theory, as well as insights on modern democratic government across the world.

A maximum of 20 students will be accepted every year.

Admission is open :

◼ to foreign students with at least a second year of U.S. law school (as part of an exchange between their university and Paris-Panthéon-Assas University) ;
◼ to students having completed a JD or any other legal degree in their home country with at least 4 years of studies, amounting to 240 ECTS credits.
◼ Exceptionally, to students with a degree amounting to 180 ECTS credits if this is justified by the legal curriculum in their country of origin.

Every year, the LL.M. will also be accessible to a maximum of 5 French students having already completed a “M2” degree, amounting to 300 ECTS credits.

Admission will be based on written applications. If the admission panel thinks it necessary, an oral examination will be possible.

Admission in the LLM will not be compatible with any other enrolment in another degree of any kind, at Paris-Panthéon-Assas University or in any other entity.

LL.M. International Business Law    

Dubai - Mauritius - Paris - Singapore

Awarded by Paris-Panthéon-Assas University, France's 1st Law University, the LL.M. International Law program deals mainly with practical case studies and certain key subjects, with a pluridisciplinary focus.

Whether in Dubai, Paris, Mauritius or Singapore, all courses are taught in English, by Professors of Law from Paris Panthéon-Assas University and professionals acting in the legal field coming from France, Europe, Asia and Africa. All courses strongly focus on case-studies and deepening of key subjects in a transversal and pluridisciplinary perspective.

The LL.M. International Business Law includes a minimum of 200 hours of teaching and welcomes approximately 30 students or trainees over a period of one academic year.

The LL.M. International Business Law program focuses on practical case studies and key topics, with a multidisciplinary orientation. It prepares students and professionals for operations such as major acquisitions or market transactions, cross-border mergers, complex financing, restructurings, LBOs, financial engineering and industrial projects. These complex operations often lead to the search for innovative solutions. It is particularly relevant to study them and analyze the legal, financial and accounting issues they raise. Thus, contracts, guarantees, financing and international trade litigation, among other fundamental subjects, are examined from different angles.

COMPETITION LAW
Purpose and characteristics of competition law (excluding the law of unfair competition) at the international and European levels.

ENVIRONMENTAL AND SUSTAINABLE DEVELOPMENT LAW

Principles governing environmental policy, international and European environmental law.

MERGERS AND ACQUISITIONS
Various forms of companies and concentrations between firms; rules governing mergers and acquisitions in an international environment.

INTERNATIONAL ARBITRATION
Resolving disputes through international arbitration (commercial, investment); the principles governing arbitration agreements, proceeding and awards.

INTERNATIONAL INTELLECTUAL PROPERTY LAW
This course will focus on the international legal instruments which enable the right balance between the interests of innovators and the wider public interest.

INTERNATIONAL CAPITAL MARKETS
Rules governing European and international capital markets.

INTERNATIONAL CONTRACTS
Legal and contractual scope and treatments applicable to international contracts.

INTERNATIONAL FINANCING
Characteristics of banking law at international level.

INTERNATIONAL TAX LAW
Subsequent to the taxation and customs law course, this course considers the international aspects of taxation and provides an introduction to the key issues of this branch of international law.

STATES AND INTERNATIONAL TRADE LAW
Main principles and rules of international trade law applicable to public contracts: BOT (Build-Operate Transfer Contracts): public-private international partnerships; litigation related to State contracts.

Programme

Each module is composed of 10 hours of theoretical teachings and 10 hours of practical teachings.

All courses are delivered in English and take the form of seminars taught by professors from Paris-Panthéon-Assas University, as well as practitioners from law firms and major companies.

An additional 10 hours for International Business Management and Finance is taught by INSEAD Professors on the following topics: Finance & Accounting, Microeconomics, and Marketing Strategy.

Assessment

Examinations will be held for each of the 10 mandatory modules. Some modules might require 2 exams: one regarding the theoretical lecture, and one regarding the practical part of the module.
The method of evaluation is determined by the respective professors/teachers with the approval of the dean.

The method of evaluation may be a written exam, class participation, project presentation, and/or homework assignment.

The format of the exam might vary from one module to another. Here are a few examples:

  • Questions with multiple answers
  • Individual work cases (essays) to be done at home
  • Assignments or presentations to be prepared in groups
  • Evaluation tests at the end of each seminar

Each subject is graded out of 20 and the pass mark is 10/20 for each module. The student is admitted if he/she has obtained at least a total of 100 points out of 200 and 60 ECTS credits will be awarded. Objectifs

Aims

Launched for the first time in Mauritius in October 2016, this programme is a reflection of the university’s willingness to develop its law programmes at the international level.
Created on the model of a French licence (3-years diploma), this LL.B. aims at providing students with a comprehensive training in law. One of the cornerstones of the programme is the consideration of the specifics of the Mauritian legal system as the latter is inspired from both civil and common law. Moreover, while the module titles are often very similar to the ones of the French licence, their content is adapted. In order to maintain coherence and to consider the students’ interest, the programme takes into account those Mauritian specifics (the Mauritian civil law is largely drawn from the French law, while the administrative law is derived from English law).
Furthermore, while this programme is mostly geared towards Mauritian students, it also aims at attracting students from the East African and Indian Ocean regions. Hence the inclusion of modules with an international scope, and the use of English (which is also Mauritius’ official language) as the medium of instruction for all classes.
In addition, core legal subjects required for any 3-year programme in law are part of the LL.B. curriculum. These include Introduction to Civil Law, Introduction to Public Law, Criminal Law, Business Law, Administrative Law, International Law (Public and Private), Personal & Family Law, Property Law, Law of Contract, Labour Law, Civil Procedure, Criminal Procedure and Evidence, Revenue Law as well as a number of modules with an international scope.
Last but not least, about 75% of the professors on the programme come from Paris-Panthéon-Assas University’s campus in France. The need to maintain a majority of French Faculty is our priority, allowing us to transfer our institution’s expertise and to highlight our uniqueness.

Admission to the LL.B. programme are to be made by the 20th of September of each year (see Art. 2 of the rules and regulations).
As indicated in the Programme’s Rules and Regulations, students eligible to apply are those holding a French Baccalaureate or equivalent level and whose application has been accepted by a commission composed of two Professors from Paris-Panthéon-Assas University.
The following list of documents is required for an application to be reviewed :

  • Motivation Letter, which should include: the reasons why you wish to study Law; you future aspirations; extracurricular activities as well as why you chose Paris-Panthéon-Assas University in Mauritius;
  • HSC / BAC / IB results (or equivalent) OR Mock results / 1st semester results of Upper 6 / Terminal / Form 7 (or equivalent);

About the programme

This core foundational program in the laws focuses on key domestic, comparative, and international legal issues.

The three-year program features face-to-face lectures and tutorials (to be rendered on-line if made necessary/as circumstances dictate), delivered by academics and renowned practitioners holding civil, common, and international law backgrounds. It also features modules which aim to provide students with a multi-disciplinary perspective.

The LL.B. program prepares students with all the necessary skills required to pursue postgraduate education, or embark on a career in the public or private sector at both the national or international levels. L’IEJ Pierre Raynaud de l’Université Paris Panthéon-Assas propose une préparation complète au concours d’entrée à l’École des officiers de la gendarmerie nationale (EOGN). La formation accompagne les étudiants à chaque étape du concours, depuis la préparation de l’admissibilité, jusqu’aux épreuves d’admission. Celle-ci est déclinée sous deux formats : en diplôme d'université ou hors diplôme d'université.

S’appuyant sur l’expérience et la fidélité de ses intervenants, professionnels et enseignants de l’Université, la formation, rigoureuse et exigeante, est réfléchie pour permettre aux étudiants une préparation progressive du concours.

L’IEJ est le partenaire académique de la « Classe Prépa Talents » de la Gendarmerie nationale (Classe de Paris) : les étudiants sélectionnés dans cette CPT par la Gendarmerie suivent les cours de l’IEJ et participent aux mêmes concours blancs. L’IEJ propose aux étudiants du DU des activités de cohésion en lien avec l’EOGN.

Les candidatures au D.U "Officier de Gendarmerie" devront être déposées au cours du mois de mai précédent le début de l'année universitaire. Une réponse sera apportée aux candidats avant la fin du mois de juin.
Les candidats sélectionnés devront acquitter les droits d'inscription au plus tard le 15 septembre.

D.U. "Officier de Gendarmerie" : droits d'inscription à l'université + complément IEJ de 740 euros.

Une réduction de 200 euros sur le complément IEJ sera accordée aux étudiants ayant déjà suivi, l’année précédente, cette même formation.

Programme

Conçu sur le modèle d’une « 6e année » universitaire, après un Master 2 en Droit, le déroulement de l’année ressemble à la fois à celui d’un Master 2 et à celui d’une classe préparatoire.

L’année se déroule en deux grandes phases :

  • de septembre à fin janvier : préparation des épreuves d’admissibilité
  • de février à juin : préparations et épreuves d’admission

La préparation sportive commence dès septembre (service des sports de l’Université)

Le DU s’appuie sur la préparation générale au Concours de l’IEJ en y ajoutant des spécificités : le Diplôme d’Université signifie, avant tout, un accompagnement régulier et individualisé : est mis en place un suivi personnalisé de l’étudiant, à travers un système de tutorat, permettant d’identifier et de surmonter ses difficultés.

Des enseignements intensifs

Les enseignements de la préparation permettent de couvrir l’ensemble du programme des épreuves écrites d’admissibilité. La préparation comprend, d’une part, des enseignements généraux (cours magistraux et méthodologies appliquées) et, d’autre part, des enseignements méthodologiques spécifiques (note de synthèse, culture générale, droit public, droit pénal, histoire – géographie).

Pour cette première étape de préparation de l’admissibilité, 530 heures d’enseignement sont réparties dans toutes les matières au programme du concours :

  • 200 heures de culture générale
  • 275 heures pour les options (droit public, droit pénal, histoire-géographie, finances publiques, sciences économiques et de gestion)
  • 6 heures de méthodologie de la note de synthèse et 4 heures de méthodologie en culture générale
  • 45 heures d’anglais

Plusieurs séances seront proposées par ailleurs dans le cadre d’un “séminaire de sécurité intérieure” comportant des séances axées sur la compréhension des institutions et sur la connaissance approfondie des enjeux de la sécurité intérieure : histoire de la force publique, organisation et missions des forces de sécurité, connaissance des institutions (Police – Gendarmerie).

Un atelier CV et lettre de motivation est organisé pour nos candidats à l’EOGN : les considérations communes sont présentées et un suivi personnalisé des candidats est réalisé.

Tous les cours et enseignements méthodologiques pourront être suivis à distance. Ainsi, ils sont proposés

  • soit en mode hybride : en présence et à distance (en direct), enregistrés et disponibles sur notre plateforme ;
  • soit exclusivement à distance (en direct, enregistrés et disponibles sur notre plateforme).

Suite à son inscription administrative, l’étudiant choisira librement lors de son inscription pédagogique s’il veut suivre les travaux dirigés et effectuer ses épreuves (concours blancs) à distance ou en présence. Après un délai d’un mois, ce choix sera irréversible, sauf accord exceptionnel des responsables de la formation.

Entraînements réguliers

Des entraînements aux épreuves écrites d’admissibilité sont régulièrement organisés dans les conditions du concours : ainsi, 4 concours blancs regroupent toutes les épreuves choisies par le candidat pour le concours.

Chaque copie bénéficie d’une correction individuelle, en plus du corrigé de l’épreuve.

Sport

Des entraînements aux épreuves sportives sont proposés tout au long de la formation dans le cadre de la préparation. L’IEJ travaille en étroite collaboration avec le service des sports de l’Université pour proposer des entraînements personnalisés en fonction du niveau de chacun des candidats et adaptés aux exigences du niveau des concours.

Sorties

Les étudiants du DU se verront proposer des sorties culturelles et visites relatives à la Gendarmerie nationale ou en lien étroit avec les questions de sécurité.

Nota Bene : La préparation EOGN, hors D.U., n’est pas diplômante. Elle a en commun avec le DU les enseignements et concours blancs

Tous les cours et enseignements méthodologiques pourront être suivis à distance. Ainsi, ils sont proposés

  • soit en mode hybride : en présence et à distance (en direct), enregistrés et disponibles sur notre plateforme ;
  • soit exclusivement à distance (en direct, enregistrés et disponibles sur notre plateforme).

Après l’inscription administrative, l’étudiant choisira librement lors de son inscription pédagogique s’il veut suivre la préparation à distance ou en présence.

Le LL.M. est un diplôme universitaire et n’est pas l’équivalent d’un diplôme de master.

Présentation

Le Diplôme d’Université « droit public et démocratie » (LL.M. public law and democracy) est un programme de formation de niveau master en langue anglaise, principalement tourné vers un public d’étudiants internationaux. Les enseignements se dérouleront à l’Institut Michel Villey et dans les différentes implantations de l’Université Paris-Panthéon-Assas.

Le public visé se compose de deux catégories d’étudiants. D’une part, il s’agit des étudiants désireux d’acquérir une expertise professionnelle dans le domaine de la pratique démocratique (associations, agences gouvernementales nationales, ONG nationales et transnationales, grandes organisations internationales). D’autre part, il s’agit d’étudiants ayant le projet de se diriger vers un doctorat et une carrière universitaire.

Objectifs

 

Le but est de donner aux étudiantes et étudiants une ouverture à la pensée démocratique et aux nouvelles pratiques de la démocratie contemporaine.

Les enseignements se répartissent entre la pensée politique, le droit constitutionnel, et les enjeux de la démocratie contemporaine.

Le  contenu de la formation  vise ainsi à rapprocher la connaissance théorique et la pratique de la démocratie.

Les enseignements seront dispensés, entièrement en anglais, par des professeurs de l'Université Paris-Panthéon-Assas ainsi que par des enseignants étrangers issus de grandes universités internationales.

Le LL.M. est accessible aux étudiants étrangers titulaires d’au moins une deuxième année de Law School américaine (dans le cadre d’un échange entre leur université d’origine et l’Université Paris-Panthéon-Assas) ; aux étudiants titulaires d’un JD ou de tout autre diplôme de fin d’études juridiques dans leur pays d’origine, comportant au minimum quatre années d’études supérieures, soit 240 crédits ECTS ; à titre exceptionnel, aux étudiants titulaires d’un diplôme comportant 180 crédits ECTS, si le parcours d’études dans le pays d’origine le justifie.

Le LLM est par ailleurs accessible à un nombre limité d’étudiants français chaque année (maximum un quart de l’effectif maximum, soit 5 étudiants) pouvant justifier de 5 années d’études (M2) et de 300 Crédits ECTS.

Les étudiants sont sélectionnés sur dossier (un maximum de 20 étudiants est admis par promotion) et, éventuellement, après un entretien si le jury de sélection le juge utile. 

L’admission dans le LLM est exclusive de toute autre inscription, au sein de l’Université Paris-Panthéon-Assas ou dans tout autre établissement français ou étranger.

Programme

Le LL.M. se déroule sur la durée d’une année universitaire.

Le programme d’enseignements du LL.M. comporte 10 enseignements obligatoires de 24h chacun, soit 240 h au total.

Unité 1 – La pensée démocratique 

  • Théories de la démocratie
  • Introduction aux idées politiques
  • Philosophie politique (séminaires de lecture)
  • Fondements du droit public

Unité 2 – Le constitutionnalisme

  • Histoire constitutionnelle et politique
  • Droit constitutionnel comparé
  • Théorie constitutionnelle
  • Droit international et démocratie

Unité 3 – La démocratie et le gouvernement démocratique

  • La gouvernance démocratique et ses techniques
  • Problèmes contemporains des sociétés démocratiques (justice transitionnelle, constitution building, crises démocratiques et democratic backsliding, …).

Hors unités : Chair of Democracy confiée à un intervenant étranger. La chaire ne fait pas l’objet d’une évaluation, mais l’assiduité est obligatoire et fera l’objet d’un contrôle.

Tous les enseignements sont dispensés sous forme de séminaires en langue anglaise. Cependant, les étudiants ont la possibilité de suivre des cours de langue française organisés à l’intention des étudiants étrangers.

Les étudiants peuvent s’inscrire dans l’enseignement de français langue étrangère (FLE). Des points leurs seront attribués à ce titre, dans la limite de 3 points venant s’ajouter au total de points dans le LLM).

Débouchés

La formation vise deux publics :

  • De futurs experts de la pratique démocratique dans les organisations internationales, ONG, etc. intervenant dans ce domaine ou comportant une cellule spécialisée ;
  • Des étudiants intéressés par une carrière universitaire, pour lesquels le LLM tiendra lieu de formation pré-doctorale.

L'anglais est indispensable pour une formation dans un domaine imprégné de pratiques anglo-saxonnes.

L'autorisation d'inscription est accordée par le président de l'université, sur proposition du responsable de la formation, après examen du dossier déposé par l'étudiant et entretien individuel.

1. Marchés financiers – 80 heures

Ce module dédié aux marchés financiers développe des thèmes relatifs aux instruments utilisés et aux opérations se déroulant sur les marchés financiers. Il traite notamment :

  • des titres et des contrats financiers ;
  • des contrats de représentation ;
  • des ordres de bourse ;
  • de la tenue des comptes ;
  • des opérations de transfert temporaires de propriété ;
  • des plateformes de négociation ;
  • Les obligations professionnelles des PSI.

2. Opérations de crédit – 75 heures

Ce module a pour objectif d’étudier la réglementation et la restructuration du système bancaire, en traitant notamment :

  • de l’environnement juridique et réglementaire de l’activité bancaire,
  • des financements bancaires syndiqués,
  • de la structuration et restructuration des opérations de financements complexes (financement d’actif, financement de projet et financement d’acquisition),
  • de la rémunération du crédit,
  • de la responsabilité civile du banquier,
  • des mécanismes de base : la cession de créances, la subrogation, la compensation, la délégation, la cession de contrat ;
  • des opérations de crédit internes : le prêt et l’ouverture de crédit, la mobilisation de créances, le crédit-bail, l’aval et le cautionnement, la prise ferme et l’acceptation ;
  • des opérations de crédit internationales ;
  • des opérations avec les consommateurs.

3. Opérations financières – 60 heures

Ce module traite des principales opérations sur le capital des sociétés cotées. Les opérations envisagées sont notamment :

  • les opérations sur le capital telles que les augmentations de capital et les différentes formes qu’elles peuvent prendre : avec ou sans DPS, offres au public ou placements privés, immédiates ou différées ;
  • les émissions de titre de créances : émissions obligataires, émissions de titres de créances négociables ;
  • les introduction en bourse : règles d’établissement du prospectus, délais et procédures, les offres public : différentes formes, franchissements de seuils, protection des actionnaires minoritaires.

4. Produits dérivés et Structured finance – 40 heures

Ce module a pour objet de présenter le marché des produits dérivés, leur régime juridique, leur documentation contractuelle spécifique, la réponse réglementaire à la crise de 2008 et les réformes qui s'en sont suivies.

Les thèmes suivants sont notamment présentés par les intervenants :

  • Présentation économique et fonctions des produits dérivés (taux, change, actions, crédit, "ESG"…) ;
  • Régime juridique des dérivés (netting, garanties financières, compensation centralisée, techniques obligatoires d'atténuation des risques, capacité juridique, traitement en résolution bancaire, etc.) ;
  • Documentation et collatéralisation des opérations sur produits dérivés (ISDA et FBF ;
  • Contentieux des produits dérivés et conflits de lois ;
  • Les opérations de titrisation (principes de base, structuration, titrisation de créances et titrisation d'autres actifs).

Une partie significative de ces enseignements est faite en anglais.

7. Contentieux financier – 20 heures

Ce module traite des spécificités des infractions financières (manquements disciplinaires et abus de marché et du contentieux financier, qu’il s’agisse des procédures administrative et disciplinaire, civile ou pénale, des procédures répressives comme des voies transactionnelles.

8. Aspects européens et internationaux – 30 heures

Ce module met l’accent sur la dimension européenne et internationale du droit bancaire et financier. Il se compose d’une partie consacrée à la réglementation bancaire européenne et d’une autre consacrée aux aspects européens et internationaux des opérations sur sociétés cotées.

Ce module traite de la surveillance prudentielle des établissements de crédit et des entreprises d’investissement ainsi que des dispositifs de traitement des difficultés de ces entités.

10. Fiscalité des instruments financiers – 30 heures

Ce module a pour vocation d’appréhender l’ensemble des problématiques fiscales liées aux sociétés cotées. L’idée est donc de maîtriser les règles applicables aux instruments utilisés et aux opérations qui peuvent intervenir sur le capital de la société.

Ce module comprend un rappel de la comptabilité des sociétés et de la comptabilisation de certaines opérations ou stratégies financières : analyse et gestion financière ; compréhension de la formation des cours de bourse et des prix des titres financiers ; étude financière des opérations de haut de bilan.
